USCIS will resume giving deference to prior decisions

On April 27, 2021, USCIS announced that it will again generally give deference to prior determinations of eligibility in petitions for an extension regarding the same parties and same facts.

This is a welcome return to earlier USCIS guidance that had been in place from 2004 until 2017. The updated guidance is effective immediately, and it is being placed in the USCIS Policy Manual, which is USCIS’s centralized online repository for their immigration policies.
